hamilton-davidObama’s first judicial appointment, U.S. District Judge David F. Hamilton to the federal appeals court has not yet been confirmed by the full Senate.

“Judge Hamilton has a long and impressive record of service and a history of handing down fair and judicious decisions,” Obama said. “He will be a thoughtful and distinguished addition to the 7th Circuit and I am extremely pleased to put him forward to serve the people of Illinois, Indiana, and Wisconsin.”

Hamilton is a former fundraiser for ACORN, as well as the former leader of the Indiana chapter of the ACLU. Considering all of ACORN’s recent problems, here, here, here, here, and here, one must wonder how many votes he’ll get now?

Hamilton is not without other controversy.

Hamilton has been involved in several controversial cases. In 2005, he ruled that the daily invocation of the Indiana House too often referred to Jesus Christ and a Christian god, in violation of the Constitution, which forbids the government to show preference for any religious denomination. The decision was overturned on appeal on technical grounds.

In 2003, Hamilton struck down part of an Indiana law requiring abortion clinics to give women information about alternatives to abortion in the presence of a physician or nurse. The information had to be given to women 18 hours before the procedure, requiring them to make two visits to the doctor’s office to obtain the procedure. That decision was also overturned on appeal.

Sen. Richard Lugar (R-Indiana) is already smitten with Hamilton. “I enthusiastically support the Senate confirmation of David Hamilton for U.S. 7th Circuit Court of Appeals. Judge Hamilton has served the Southern District of Indiana with distinction as U.S. District Court Judge,” Lugar said.

In 1994, when President Clinton nominated him to the district court, the ABA rated him as “not qualified,” because of his almost purely political (as opposed to legal and judicial) experience. Gee, we elected a president under the similar conditions.

ACORN not only resurrects the dead and gets them to the polls every election, they’re also willing to setup houses of prostitution using minor girls brought in illegally from other countries. Now there’s a backlash.

The house just moments ago voted on an ACORN funding ban, 345-75

The US House today joined the Senate in voting to defund ACORN, the community advocacy group beset by allegations of voter registration fraud and videotapes apparently showing employees advising conservative activists posing as a prostitute and pimp how to break the law.

The measure, offered as part of a motion on a student loan bill, passed by a vote of 345-75, according to the office of House Republican leader John Boehner.

The Senate voted earlier this week to withdraw housing and urban development funding. Last week, the Census Bureau severed ties with ACORN, which on Wednesday said it is suspending accepting new clients during an investigation.

But congressional Republicans are calling for all federal funds to be cut off and for a Justice Department investigation.

I wonder how Lugar feels now?
