Last week Senators John Rockefeller (D-W. Va.) and Olympia Snowe (R-Maine) introduced Cybersecurity Act of 2009, S.773 [PDF file], which would establish the Office of the National Cybersecurity Advisor and be an arm of the executive branch.

ponyexpress[1]The Cybersecurity Act of 2009 gives the president the ability to “declare a cybersecurity emergency” and shut down or limit Internet traffic in any “critical” information network “in the interest of national security.” The bill does not define a critical information network or a cybersecurity emergency. That definition would be left to the president.

The bill does not only add to the power of the president. It also grants the Secretary of Commerce “access to all relevant data concerning [critical] networks without regard to any provision of law, regulation, rule, or policy restricting such access.” This means he or she can monitor or access any data on private or public networks without regard to privacy laws. What happened to the Fourth Amendment?

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

There are two noteworthy section is this bill.

SEC. 14. PUBLIC–PRIVATE CLEARINGHOUSE.

(a) DESIGNATION.—The Department of Commerce shall serve as the clearinghouse of cybersecurity threat and vulnerability information to Federal government and private sector owned critical infrastructure information systems and networks.

(b) FUNCTIONS.—The Secretary of Commerce—

(1) shall have access to all relevant data concerning such networks without regard to any provision of law, regulation, rule, or policy restricting such access; …

SEC. 18. CYBERSECURITY RESPONSIBILITIES AND AUTHORITY.

The President— …

(2) may declare a cybersecurity emergency and order the limitation or shutdown of Internet traffic to and from any compromised Federal government or United States critical infrastructure information system or network; …

Remember when the left got their panties in a wad over the Patriot Act? I’ve been looking over some of the more notable left-wing blogs, and they’re not really saying much of anything about this.

Then you have liberal dipshits like Jay Rockefeller (D-W.V.), who co-sponsored the bill that think the Internet is the greatest threat to homeland security and should never have been invented. What a dolt.

Maybe it’s time we bring back the Pony Express, Jay?

Well there you have it folks, Al Gore invented the Internet, and soon, Obama may be able take it away.

    Holy shit, the “he’s a fascist rhetoric” would have been all over the front page of every newspaper 24-7….
